《成都市城镇职工基本医疗保险办法》已经2008年11月3日市政府第22次常务会议讨论通过,现予以公布,自2009年1月1日起施行。

成都市城镇职工基本医疗保险办法
第一条 (目的依据)
为进一步完善城镇职工基本医疗保险制度,规范基本医疗保险管理,保障城镇职工基本医疗需求,根据国家有关规定,结合成都市实际,制定本办法。
第二条 (参保范围)
本市行政区域内的下列城镇单位和人员,应当参加城镇职工基本医疗保险:
(一)企业(包括各种所有制和组织形式的企业)及其职工;
(二)国家机关及其工作人员、事业单位及其职工、社会团体及其专职人员;
(三)民办非企业单位及其职工;
(四)个体工商户及其雇工、自由职业者、灵活就业人员;
(五)法律、法规规定或经省、市政府批准的其他单位和人员。
本市行政区域内的外国人、无国籍人、港澳台地区人员、离休干部和已在省本级和本市行政区域外参加城镇职工基本医疗保险的人员不适用本办法。
第三条 (基本原则)
城镇职工基本医疗保险遵循以下原则:
(一)基本医疗保险水平与经济社会发展水平相适应;
(二)基本医疗保险费由单位和个人共同缴纳;
(三)基本医疗保险基金实行社会统筹与个人账户相结合;
(四)基本医疗保险基金以收定支,收支平衡,略有节余。
第四条 (主管部门)
市劳动和社会保障行政部门负责全市城镇职工基本医疗保险管理工作。区(市)县劳动和社会保障行政部门负责本区(市)县行政区域内的城镇职工基本医疗保险管理工作。
市和区(市)县社会保险经办机构、医疗保险经办机构依照各自职责负责办理城镇职工基本医疗保险业务。
第五条 (统筹模式)
城镇职工基本医疗保险基金(以下简称基本医疗保险基金)实行市级统筹,统一参保范围、统一缴费标准、统一待遇水平、统一管理办法。
第六条 (缴费标准)
单位职工的基本医疗保险费由单位和职工按月共同缴纳,有雇工的个体工商户雇工的基本医疗保险费由雇主和雇工按月共同缴纳,从业年龄内无雇工的个体工商户、自由职业者、灵活就业人员(以下统称个体参保人员)的基本医疗保险费由本人按月缴纳:
(一)单位缴纳基本医疗保险费,以全部职工工资总额为缴费基数,缴费费率为7.5%;
(二)有雇工的个体工商户缴纳基本医疗保险费,以雇主和全部雇工的工资总额为缴费基数,缴费费率为7.5%;
(三)职工或个体工商户雇主和雇工个人缴纳基本医疗保险费,以本人上月工资为缴费基数,缴费费率为2%,由所在单位或雇主在工资中代扣代缴;
(四)个体参保人员缴纳基本医疗保险费,可按上一年度成都市职工平均工资的80%为缴费基数,缴费费率为9.5%;也可按上一年度成都市职工平均工资为缴费基数,缴费费率为4%,不建个人账户,享受住院医疗保险待遇。
除本条第一款第(四)项外的参保人员,月工资低于上一年度成都市职工月平均工资60%的,按60%计算缴费基数;月工资超过上一年度成都市职工月平均工资300%的,其超过部分不计入缴费基数。
第七条 (基金构成)
基本医疗保险基金分设统筹基金和个人账户,统筹基金和个人账户分别核算,互不挤占。
第八条 (个人账户设立)
单位参保人员个人和雇工缴纳的基本医疗保险费,全部计入个人账户;个体参保人员和单位及雇主缴纳的基本医疗保险费,按一定比例计入个人账户;退休人员的个人账户金全部从征收的基金中划入。具体划入标准为:
(一)未满50周岁的在职参保人员,个人缴费全部计入后,每1周岁再增加本人缴费基数的0.02%;
(二)已满50周岁的在职参保人员,个人缴费全部计入后,每1周岁再增加本人缴费基数的0.035%;
(三)未满50周岁的个体参保人员,按本人缴费基数的2%划入后,每1周岁再增加本人缴费基数的0.02%;
(四)已满50周岁的个体参保人员,按本人缴费基数的2%划入后,每1周岁再增加本人缴费基数的0.035%;
(五)退休人员,按上一年度成都市职工平均工资2%划入后,每1周岁再按上一年度成都市职工平均工资增加0.035%。本人基本养老金高于上一年度成都市职工平均工资的,以本人基本养老金为个人账户计入基数。
个人账户金利息按国家、省有关规定年末计入个人账户。
第九条 (个人账户支付范围)
个人账户金属于参保人员个人所有,可以结转和继承,除参保人员长期在本市行政区域外工作、居住或死亡等原因外,个人账户金不得提取。其支付范围为:
(一)参保人员在定点零售药店购买药品或有利于疾病治疗和康复的医疗器械等发生的费用;
(二)参保人员在定点医疗机构发生的门诊医疗费用、应由个人自付的住院医疗费用。
第十条 (统筹基金支付范围)
统筹基金为参保人员支付下列起付标准以上、最高限额以下符合本办法规定报销范围内的费用:
(一)住院医疗费用;
(二)因患特殊疾病需长期进行门诊治疗发生的门诊医疗费用;
(三)因病丧失全部或部分行动能力,在定点医疗机构开设的家庭病床发生的医疗费用;
(四)门诊抢救无效死亡发生的医疗费用;
(五)住院期间因所在医疗机构条件限制发生在其他定点医疗机构的检查和手术费用;
(六)入院前3日内的阳性特殊检查费用;
(七)因工作、居住等原因在异地就医发生的符合基本医疗保险规定的医疗费用。
医疗保险经办机构按照有关规定,对参保人员的家庭病床、特殊疾病门诊、异地就医(含市外转诊)等申请进行审核。具体管理办法,由市劳动和社会保障行政部门另行制定。
第十一条 (统筹基金起付标准)
统筹基金起付标准按医院级别确定,一级医院200元,二级医院400元,三级医院800元,符合条件并与医疗保险经办机构签订住院医疗服务协议的社区卫生服务中心(含乡镇卫生院,下同)160元,市外转诊起付标准为2000元。有下列情形之一的,起付标准可进行减免:
(一)参保人员在一个自然年度内多次住院的,逐次降低100元,但最低不低于160元;
(二)参保人员因精神病或艾滋病在定点医疗机构发生的符合基本医疗保险报销范围的住院医疗费用不计统筹基金起付标准;
(三)年满100周岁及以上的参保人员,因病在定点医疗机构发生的符合基本医疗保险报销范围的住院医疗费用不计统筹基金起付标准;
(四)参保人员因恶性肿瘤手术及放化疗治疗,肾功能衰竭透析治疗及移植手术,肝、肾、骨髓移植术后的抗排斥治疗,慢性白血病,重型再生障碍性贫血,骨髓增生异常综合症及骨髓增生性疾病,系统性红斑狼疮在定点医疗机构多次住院发生的符合基本医疗保险报销范围的住院医疗费用,一年计算一次起付标准。起付标准按参保人员年度内首次所住定点医疗机构的级别确定;
(五)参保人员因病情需要,由低级别的定点医疗机构转往高级别的定点医疗机构、由专科医院转往综合医院,只补计统筹基金起付标准差额;由高级别专科医院转往同级别或低级别综合医院或由高级别定点医院转往符合条件的社区卫生服务中心,不再另计统筹基金起付标准。
已按本条规定执行起付标准的参保人员,办理门诊特殊疾病和家庭病床时,应按成都市基本医疗保险门诊特殊疾病和家庭病床管理办法的规定支付起付标准。
第十二条 (统筹基金最高支付限额)
一个自然年度内统筹基金为个人支付的医疗费累计不超过上一年度成都市职工平均工资的4倍。
第十三条 (统筹基金支付比例)
参保人员在定点医疗机构发生的符合本办法规定的一次性住院医疗费用,其数额在统筹基金起付标准以上的部分,扣除个人首先自付的费用后,由统筹基金根据医院级别按比例支付:三级医院85%,二级医院90%,一级医院92%,与医疗保险经办机构签订了住院医疗服务协议的社区卫生服务中心95%。在此基础上,年满50周岁的增加2%,年满60周岁的增加4%,年满70周岁的增加6%,年满80周岁的增加8%,年满90周岁的增加10%。根据年龄增加后的医疗费报销比例,不得超过100%。
年满100周岁及以上参保人员在定点医疗机构发生的符合基本医疗保险报销范围的住院医疗费报销比例为100%。
个人首先自付的费用包括:
(一)使用除手术外单项价格在200元以上的检查、治疗项目费20%的费用;
(二)实施单项价格在1000元以上手术费10%的费用;
(三)使用国家和省规定的《基本医疗保险药品目录》中乙类药品费10%的费用;
(四)使用特殊医用材料和施行统筹基金支付部分费用的诊疗项目应由个人自付的费用。具体标准由市劳动和社会保障行政部门另行制定。
第十四条 (床位费)
本市城镇职工基本医疗保险住院床位费按日限额纳入报销范围的标准为:一级医院和社区卫生服务中心15元,二级医院20元,三级医院30元。专科医院或专科病房床位费在上述标准基础上,按照物价部门规定的上浮比例执行。
第十五条 (不予支付情形)
参保人员发生的下列医疗费用不属于统筹基金支付范围:
(一)基本医疗保险药品目录、医疗服务设施和诊疗项目、医用材料目录和支付标准范围以外的医疗费用;
(二)工伤(职业病)、生育发生的医疗费用;
(三)除急救、抢救外在非定点医疗机构发生的医疗费用;
(四)因本人吸毒、打架斗殴、违法犯罪等造成伤害发生的医疗费用;
(五)因自伤、自残、醉酒、戒毒、性传播疾病(不含艾滋病)等进行治疗发生的医疗费用;
(六)因美容矫形、生理缺陷及因不孕不育等进行治疗发生的医疗费用;
(七)第三方责任等引发的非疾病医疗费用;
(八)在港澳台地区和境外发生的医疗费用;
(九)因交通事故、医疗事故发生的医疗费用。
交通事故能提供公安交通管理部门出具的肇事方逃逸或无第三方责任人的相关证明,且没有获得相关赔偿或补偿的,其在定点医疗机构住院发生的医疗费用可列入统筹基金支付范围。
第十六条 (缴费年限)
缴费年限按下列规定执行:
(一)本办法实施前,单位和有雇工的个体工商户已参加本市城镇职工基本医疗保险的人员,连续不间断缴费达到法定退休年龄并按国家和省、市有关规定,经有关部门办理退休手续、领取养老金后,不再缴纳基本医疗保险费,继续享受基本医疗保险待遇;
(二)本办法实施前,已参加本市城镇职工基本医疗保险的国有、集体企业和机关事业单位,破产、改制或机构改革后,与原单位解除劳动关系的职工,应以个体身份连续不间断参加城镇职工基本医疗保险,缴费至法定退休年龄并按国家和省、市有关规定,经有关部门办理退休手续、领取养老金后,不再缴纳基本医疗保险费,继续享受基本医疗保险待遇;
(三)本办法实施前,经批准缴纳住院基本医疗保险费的参保人员,达到法定退休年龄并按国家和省、市有关规定,经有关部门办理退休手续、领取养老金后,不再缴纳基本医疗保险费,建立个人账户,继续享受基本医疗保险待遇;
(四)本办法实施前,个体参保人员缴纳基本医疗保险费累计满15年的,达到法定退休年龄并按国家和省、市有关规定,经有关部门办理退休手续、领取养老金后,不再缴纳基本医疗保险费。缴纳基本医疗保险费的累计年限不足15年的,应按规定继续缴费至累计缴费年限达到15年;
(五)本办法实施以后,初次参加本市城镇职工基本医疗保险的人员,连续不间断缴费满15年或累计缴费满20年,达到法定退休年龄并按国家和省、市有关规定,经有关部门办理退休手续、领取养老金后,不再缴纳基本医疗保险费。连续不间断缴纳基本医疗保险费不足15年或累计缴纳基本医疗保险费不足20年的,应按规定继续缴费至连续缴费年限达到15年或累计缴费年限达到20年。
第十七条 (费用清偿)
企业破产以及单位改制、解散或撤销,应当依照相关规定优先清算、清偿基本医疗保险费。
第十八条 (欠费处理)
参保单位和个人未按照本办法的规定,连续不间断足额缴纳基本医疗保险费发生欠费时,按下列规定处理:
(一)参保单位、有雇工的个体工商户和个人从欠费之日起,停止享受医疗保险待遇;
(二)欠费3个月以下补足的,连续享受医疗保险待遇;
(三)单位及有雇工的个体工商户因特殊情况欠费,经申请并按规定足额补缴欠费期间的基本医疗保险费、利息和滞纳金后,可补记参保人员个人账户金和缴费年限。欠费期间发生的住院医疗费,统筹基金按规定予以支付;
(四)个体参保人员欠费4个月以上的视为中断,欠费期间的保费不能补缴。重新参保后,缴费年限可累计计算。
第十九条 (保险关系衔接)
军队转业、复员和退役到地方工作的人员,军龄视为缴费年限。在6个月内接续医疗保险关系的,从缴费之日起享受医疗保险待遇;超过6个月接续医疗保险关系的,按本办法第二十条第一款规定执行。
本市城镇职工基本医疗保险、城乡居民基本医疗保险和非城镇户籍从业人员综合社会保险之间的保险关系转移衔接办法,由市劳动和社会保障行政部门另行制定。
第二十条 (待遇支付起始时间)
初次参加本市城镇职工基本医疗保险的人员、中断基本医疗保险关系或欠费4个月以上的,自参保或重新参保之日起,连续缴费满12个月以后发生的住院医疗费用,统筹基金按本办法规定予以支付,个人账户从缴费当月起计入。
单位职工缴费不满12个月突发重大疾病,经所在单位申报、医疗保险经办机构核实,其住院医疗费按本办法规定支付。
第二十一条 (结算管理)
统筹基金由医疗保险经办机构按项目付费和定额结算相结合的支付方式,与基本医疗保险定点医疗机构和定点零售药店结算:
(一)参保人员门诊就医或购药,属于基本医疗保险支付范围的门诊医疗费或药费,凭社会保险卡在定点医疗机构或定点零售药店记账,由定点医疗机构或定点零售药店与医疗保险经办机构结算;
(二)参保人员住院期间的医疗费用,统筹基金支付的部分由定点医疗机构与医疗保险经办机构结算,应由个人负担的部分由定点医疗机构与个人结算。参保人员入院时,应向定点医疗机构预付一定数额的医疗费用,用于支付应由个人承担的部分。具体数额由定点医疗机构根据病情确定,出院时定点医疗机构直接与参保人员结算。
第二十二条 (基金监管)
基本医疗保险基金纳入社会保障基金财政专户管理,专款专用,任何单位和个人不得挪用。社会保险经办机构、医疗保险经办机构用于医疗保险业务的工作经费由同级财政预算解决。
劳动和社会保障行政部门、财政部门对基本医疗保险基金实行监督管理;审计部门定期对医疗保险基金收支和管理情况进行审计。
第二十三条 (计息与超支处理)
统筹基金按国家、省的规定计息,利息部分纳入统筹基金管理。
统筹基金出现超支时,市劳动和社会保障行政部门、财政部门应及时向市政府报告,由市政府采取措施予以解决。
第二十四条 (定点管理)
城镇职工基本医疗保险实行定点医疗机构和定点零售药店管理,定点医疗机构和定点零售药店由劳动和社会保障行政部门确定。
市劳动和社会保障行政部门会同市卫生、药监等部门,根据国家和省有关规定,制定定点医疗机构和定点零售药店管理办法。
第二十五条 (基本医疗目录)
市劳动和社会保障行政部门根据国家和省有关规定,制定基本医疗保险有关医疗服务设施和诊疗项目、药品目录的管理办法,明确支付标准。
医院制剂纳入基本医疗保险用药范围和支付标准,由市劳动和社会保障行政部门审核确定。
第二十六条 (服务协议)
医疗保险经办机构与定点医疗机构和定点零售药店按年度签订医疗保险服务协议,确定双方的权利和义务。服务协议的内容包括:服务对象、服务范围、服务内容、服务规范,统筹基金支付费用控制指标,医疗费用结算办法、支付标准及违约责任等。
第二十七条 (定点机构管理责任)
定点医疗机构和定点零售药店应配备专职或兼职管理人员,与医疗保险经办机构共同做好医疗服务管理工作。对参保人员的医疗费用实行单独建账,并按要求真实、及时、准确地向医疗保险经办机构提供参保人员医药费用等有关信息。
医疗保险经办机构检查和审核参保人员医疗费用,定点医疗机构和定点零售药店应积极配合。
第二十八条 (参保单位违规责任)
参保单位违反有关财务、会计、统计法律、法规和国家有关规定,伪造、变造、故意毁灭有关账册、材料,或者不设账册,致使医疗保险费基数无法确定的,依照国务院《社会保险费征缴暂行条例》处理;迟延缴费的,由劳动和社会保障行政部门责令限期缴纳;逾期仍不缴纳的,除补缴欠缴数额外,从欠费之日起,按日加收2‰的滞纳金并入基本医疗保险基金,并对直接负责的主管人员和直接责任人员处5000元以上2万元以下的罚款。逾期拒不缴纳医疗保险费、滞纳金的,由劳动和社会保障行政部门申请人民法院强制执行。
参保单位未按照规定申报应当缴纳的医疗保险费数额的,由劳动和社会保障行政部门责令限期改正;逾期不改的,对单位处以瞒报工资数额1倍以上3倍以下罚款,对其直接负责的主管人员和直接责任人员可以处1000元以上5000元以下的罚款;情节严重的,对直接负责的主管人员和直接责任人员可以处5000元以上1万元以下的罚款。
第二十九条 (个人违规责任)
参保人员或其他人员有下列行为之一的,由医疗保险经办机构追回其从基本医疗保险基金中报销的医疗费用,由劳动和社会保障行政部门处200元以上1000元以下罚款;并视情节轻重,暂停其6个月以上24个月以下基本医疗保险待遇;构成犯罪的,依法追究刑事责任:
(一)将本人的社会保险卡借给他人冒名住院或办理门诊特殊疾病、家庭病床就医的;
(二)伪造或冒用他人社会保险卡住院或办理门诊特殊疾病、家庭病床就医的;
(三)伪造、涂改医疗文书、单据等有关凭证,虚报冒领基本医疗保险待遇的;
(四)其他骗取基本医疗保险基金的行为。
第三十条 (定点医疗机构违规责任)
定点医疗机构及其工作人员有下列行为之一的,由医疗保险经办机构追回其从基本医疗保险基金中获取的费用,由劳动和社会保障行政部门责令整改,并处违规金额1至3倍的罚款,对直接责任人员处500元以上2000元以下罚款;情节严重的,由劳动和社会保障行政部门取消其定点医疗机构资格;构成犯罪的,依法追究刑事责任:
(一)将不符合住院条件的参保人员收住入院或将符合出院条件应予出院的参保人员继续滞留住院的;
(二)未按规定查验身份证明和社会保险卡导致他人冒名住院的;
(三)经核实无病历记载或病历记载与发生的医疗费用不符的,或确属过度用药、诊疗的;
(四)采取虚记费用、串换药品或诊疗项目、伪造证明或凭据等手段骗取基本医疗保险基金的;
(五)其他违反基本医疗保险规定,造成基本医疗保险基金损失的。
第三十一条 (定点零售药店违规责任)
定点零售药店及其工作人员有下列行为之一的,由医疗保险经办机构追回其从基本医疗保险基金中获取的费用,由劳动和社会保障行政部门责令整改,处违规金额1至3倍的罚款,并对直接责任人员处500元以上2000元以下罚款;情节严重的,由劳动和社会保障行政部门取消其定点零售药店资格;构成犯罪的,依法追究刑事责任:
(一)不按处方规定配(售)药品或超剂量配(售)药品,擅自更改外配处方的;
(二)违反药品价格政策,弄虚作假,造成基本医疗保险基金损失的;
(三)为参保人员套取个人账户现金的;
(四)用参保人员的个人账户支付个人账户使用范围外的其他费用的;
(五)其他违反基本医疗保险规定的行为。
第三十二条 (经办部门的违规责任)
社会保险经办机构、医疗保险经办机构及其工作人员有下列行为之一的,由劳动和社会保障行政部门责令改正,对直接负责的主管人员和直接责任人由劳动和社会保障行政部门或者监察机关依法给予行政处分;构成犯罪的,移送司法机关依法追究刑事责任;造成基本医疗保险基金流失的,由劳动和社会保障行政部门负责追回:
(一)减免参保单位和在职职工应当缴纳的医疗保险费的;
(二)不按规定审核参保单位、职工的缴费工资基数,以及违反基本医疗保险基金使用管理规定,造成基本医疗保险基金损失的;
(三)擅自更改基本医疗保险待遇或者放宽支付标准的。
第三十三条 (奖励制度)
对举报骗取医疗保险待遇或基本医疗保险基金行为的单位和个人,劳动和社会保障行政部门可给予适当的奖励,奖励经费由同级财政单独列支。
第三十四条 (补充医疗保险)
在实行基本医疗保险的基础上,建立重大疾病医疗补助制度、补充医疗保险制度。具体管理办法由市人民政府另行制定。
第三十五条 (实施细则)
市劳动和社会保障行政部门应根据本办法的规定制定实施细则,报市人民政府备案。
第三十六条 (政策调整)
本办法实施过程中,国家、省对城镇职工基本医疗保险政策做出调整时,市劳动和社会保障行政部门可对本办法进行修改,报市人民政府同意后执行。
城镇职工基本医疗保险个人账户和统筹基金支付范围和标准,由市劳动和社会保障行政部门根据经济社会发展水平、基金收支结余情况、医疗费用增长幅度等因素适时调整。
第三十七条 (解释机关)
本办法具体应用中的问题由市劳动和社会保障行政部门负责解释。
第三十八条 (术语解释)
本办法中下列用语的含义:
(一)本办法所称“以上”或“以下”,均含本数;
(二)本办法所称“起付标准”,是指统筹基金在支付报销范围内住院医疗费时的起始标准,标准以下的部分由个人负担;
(三)本办法所称“最高支付限额”,是指在一个自然年度内,统筹基金为参保人员个人支付的医疗费最高额度;
(四)本办法所称“一次性住院医疗费”,是指一张出院证或病情证明所证实的从入院到出院期间连续不间断发生的医疗费用总额;
(五)本办法所称“年度”、“自然年度”均指每年的1月1日至12月31日;
(六)本办法所称“急救”和“抢救”是指对突然遭受意外伤害者或病情严重危急者所进行的紧急救治。
第三十九条 (施行时间)
本办法自2009年1月1日起施行。成都市人民政府2000年12月1日发布的《成都市城镇职工基本医疗保险暂行办法》(成府发〔2000〕184号)和2006年6月30日发布的《成都市城镇职工基本医疗保险补充规定》(成府发〔2006〕54号)同时废止。

PART II SECURITIES AND FUTURES COMMISSION

There is hereby established a body to be known as the Securities
and

The Commission shall be a body corporate with power to sue
